Rental agreement

Terms and Conditions

These terms and conditions apply to all Wakefield Campervan Hire bookings and must be accepted by  customers during the booking process for us to proceed with a booking.

Agreement

Wakefield Campervan Hire hires the vehicle to the customer subject to the terms and conditions  outlined in this agreement. By signing the agreement, the vehicle hirer, who completed the original  booking form or who had it completed on their behalf, confirms that they will abide by the terms of  this agreement.

The customer must not transfer, assign, or sublet the benefit of the agreement, or claim ownership of  or rights to the vehicle in any way other than those conferred by this agreement. Wakefield  Campervan Hire allows the customer to use the vehicle only under the terms of this agreement.

The Self-drive Hire Agreement includes these terms and conditions, the Booking Form, the Booking  Confirmation, the insurance policy or policies covering the Vehicle and any additional equipment  hired, the Vehicle handover/return form, our invoice(s), and any correspondence we send to you  containing details about the Vehicle and/or Hire Period, pricing, and/or payment.

Terms of Hire

The terms used throughout correspond to the following Definitions:

‘The vehicle’ – The VW Campervan

‘This agreement’ – Wakefield Campervan Hire Self-Drive Hire Agreement terms & conditions. ‘The hirer/customer’ – The person/s signing this agreement

‘Security deposit’ – Sum held as deposit to cover the cost of any liabilities

  1. Booking Form

The form filled out online or over the phone at the time of booking that includes the Hirer’s full name,  date of birth, and permanent address, the Hire Period, the Vehicle requested, the names, numbers,  and ages of any additional drivers and passengers, any optional services (such as a bike rack, awning,  etc.), the total charge for the booking, and the deposit taken upon completion of the Booking Form.

  1. Booking Deposit

To secure the dates, we require a non-refundable deposit of £150 per booking. 3. Booking Confirmation

An email containing these terms and conditions as well as the Booking Form. The booking form will  confirm the hire charge details, confirm the Booking Deposit has been taken, and the next steps you  need to take if the booking can be taken. When we send this communication, the Agreement comes into effect. If we are unable to accept the booking request, we will refund the Booking Deposit.

The balance of the hire charge must be paid at least 6 weeks prior to the start of the Hire Period, or  we reserve the right to rent the Vehicle to someone else and you will forfeit your Booking Deposit. All  bookings made less than 6 weeks before the Hire Period must be paid in full at the time of booking.

We will make every effort to accommodate booking date changes. This, however, may not always be  possible.

  1. Hire Period

The period for which you request to hire the Vehicle, as shown on the Booking Form, plus any  extensions due to late return of the Vehicle not previously agreed.

  1. Travel Distance

Only travel within the United Kingdom is permitted. The insurance included with the vehicle rental  does not cover travel outside of the United Kingdom.

  1. Insurance

The hirer receives fully comprehensive insurance coverage as long as he or she meets the  requirements outlined in Clause 8 – Driver Qualification.

Two additional drivers may be added to the rental agreement if they meet the requirements  outlined in Clause 8 – Driver Qualification and pay the additional driver fee of £10.00 per day per  driver.

We interpret your declaration of good health to mean that you have no mental or physical  disabilities that would prevent you from driving, such as a stroke, deafness, heart condition,  diabetes, amputation, loss of limb, loss of sight in an eye, or epilepsy. Furthermore, we interpret it to  mean that you are not using any drugs that could impair your driving.

The insurance does not cover towing charges or driving off-road, on unpaved roads, without due care  and attention, negligently, or while under the influence of alcohol or other drugs. As a result, you will  be liable for the full cost of any damage or recovery costs incurred in such circumstances.

It is critical that you answer all sections of the Booking Form honestly and accurately (or notify us if  drivers’ circumstances change between making the booking and the start of the Hire Period); failing  to do so may result in us being unable to insure your booking if this information becomes available  too close to the Hire Period to discuss with our insurer.

Under these conditions, the booking would be considered a cancellation by the Hirer, and payment  would be subject to the cancellation terms outlined in these terms and conditions.

If you do not provide us with complete and accurate information, your insurance may be rendered  invalid. In this case, you will be liable for any and all losses incurred during the Hire Period, including  third-party claims.

  1. Excess

Windscreens, windows, wheels, tyres, the undercarriage, the roof, and the interior of the vehicle are  not covered by excess, and you will be liable for the full cost of any damage to these.

Furthermore, the excess does not apply to towing charges, or if the vehicle is driven off-road, on  unpaved roads, without due care and attention, negligently, or while under the influence of alcohol

or other drugs. As a result, you will be liable for the full cost of any damage as well as recovery costs  incurred in such circumstances.

We may  be unable to accept your booking if the details do not match, or if they are not your current permanent  UK address. In these cases, the Hirer’s booking will be treated as a cancellation, and payment will be  subject to the cancellation terms outlined in these terms and conditions.

The validity of the records submitted as proof of signature must be current as of the start date of the  Hire Period. Any of the following documents can serve as proof of signature:

  • Passport
  • Signature panel of Credit or Debit card

All drivers are required to bring their driver’s licences (photocard and paper counterpart if old-style),  as well as their proof of address and proof of signature documents, on the day the Hire Period  begins. If a driver has an old-style licence, we will need their passport to verify their likeness and allow  us to examine the original documents. This is to ensure that we can physically verify the driver’s  likeness to the photo. You consent to the use of the Vehicle by only pre-authorised and pre-identified individuals.

Follow the steps below on how to get a DVLA Access Code. You will need the following information:

  • Driving Licence number
  • National Insurance number
  • Post Code

Step 1: Go to https://www.gov.uk/view-driving-licence and select start now, enter your details as  prompted. Select ‘View now’, to see licence information held. Then select the ‘get your check code’  tab. Now view your licence information’, then ‘print’ or ‘save as pdf’ the licence summary.

Step 2: Send an email to info@wakefieldcampervanhire.co.uk supplying your DVLA licence summary  pdf. The email needs to be sent from the same email address you used to book, and you should quote  your Booking ID.

All driving licence information supplied by the DVLA and .gov website is held privately by Wakefield  Campervan Hire and will not be shared with hirers.

Step 3: Look out for our email confirming your licence has been successfully verified.

Step 4: Make sure you bring your driver’s licence when collecting the vehicle. A picture will be taken,  and details recorded in the Pre-hire checklist.

The driving licence check code is good for 21 days, and in an effort to prevent problems or delays on  the day the Hire Period begins, we ask that you provide the code and other forms of identification.

seven to ten days before the Hire Period starts. This will also speed up the vehicle handover on the  day you pick up the vehicle.

  1. Cancellation

It will be assumed that the customer has cancelled their reservation if they do not pick up their vehicle  on the scheduled date and within the scheduled window of time. In this case, no refunds will be given.

More than 42 days (6 weeks) before the start of the Hire Period, if you cancel after we have confirmed  your booking reservation, we will keep the £150 booking deposit and you owe us nothing else.

50% of the total hire charges are due if you cancel within 15 to 42 days of the start of the hire period.  If you cancel within less than 15 days of the start of the Hire Period or after the Hire Period, you will  owe us 100% of total hire charge.

Booking deposits cannot be applied to different hire dates if the customer cancels the reservation. We  are unable to move money from one hire to another or postpone it. However, we will waive the  cancellation fee but not the booking deposit if we are successful in securing another reservation for  the vehicle for the same hire period. We accept no liability for any charges or costs you incur as a  result of cancellation.

All cancellations must be submitted in writing to info@wakefieldcampervanhire.co.uk and it is  strongly advised hirers to take out their own travel insurance against any unavoidable cancellation.

If Wakefield Campervan Hire cancels, the full paid amount will be refunded, unless the termination is  due to your breach of the terms of this Agreement, in which case the termination will be treated as a  cancellation by the Hirer, and payment will be subject to the cancellation terms set out in these terms  and conditions.

  1. Security Deposit

We require a deposit of £1,000 (unless otherwise stated) before the start of the Hire Period for the  purposes outlined below. This must be paid in cleared funds via bank transfer or credit/debit card  payment before you can drive the vehicle. We do not accept cheques, and the credit/debit card used  for the security deposit must be in the name of the hirer.

The security deposit is required to cover the potential for damage to the vehicle, its fixtures and  fittings, damage or loss of hired equipment or inventory (including but not limited to fuel and keys),  the potential for the interior of the vehicle to not be returned odour-free and clean, and the potential  for fines and other legal fees to have been incurred during the hire period (this includes but is not  limited to parking fines, speeding fines, road tolls, the full costs associated with the Vehicle being impounded and on the spot fines), the potential for the Vehicle to be returned late or any additional  expenses we incur as a result of your breach of these terms. It should be noted that any such fees will  be subtracted from other funds besides the security deposit. You agree that we have the right to make  such deductions by agreeing to this Agreement.

We will refund the Security Deposit if the following conditions met;

  1. On time
  2. To the correct location
  3. Undamaged
  4. With a clean interior
  5. A full tank of fuel
  6. All fixtures and fittings in good clean and working condition.
  7. Please note, exterior washing is not necessary.

We will refund the Security Deposit, minus any deductions (for the events described in this clause) upon safe return of the Vehicle and all equipment/inventory hired out with it, as long as it is in the  condition it left our premises, as specified in the Vehicle handover/return form, and subject to  confirmation that no fines and/or other legal charges have been incurred. The Hirer agrees that our  decision to return the Vehicle in the same condition is final.

Following the conclusion of the hire period, we will bank transfer the Security Deposit refund, less any  deductions (for the situations listed in this clause); this will happen within 7 working days. However,  if an incident during the Hire Period results in an insurance claim, we reserve the right to hold onto  the Security Deposit for however long is necessary to work out what must be subtracted from it to  ensure that we are fully compensated.

We will provide you with an itemised invoice detailing any costs we incur that we charge against the  Security Deposit.

The Vehicle will be supplied with a full tank of fuel and must be returned with a full tank of fuel; if it is  not, we will charge you for the cost of fuel plus a Fuel Administration Charge.

Wakefield Campervan Hire reserve the right to charge for the following:

– A £30.00 per hour late return charge if the van is returned after the agreed drop off time. – A fuel refill charge to cover the cost of filling the tank, plus a £20.00 administration fee. – A valeting fee of £100.00 if the vehicle is not returned clean and tidy.

– A £25 charge if the portable toilet has not been thoroughly washed and cleaned – £5 plus postage and packing per item to return property left in the Vehicle, provided you contact us  within 7 working days of the Hire Period’s end

  1. Our responsibilities:

We will supply the vehicle to you, or provide you with a suitable substitute, in good overall and  operational condition, along with all required documentation, parts, and accessories. We will also  make sure the vehicle is adequately insured. At the beginning of the hire period and when the vehicle  is returned, we will examine the vehicle’s equipment and inventory in your presence. This inspection  includes the windscreen, windows, tyres, wheels, undercarriage, roof, and interior, all of which are  not insured and are subject to the hirer’s liability for damage.

We will provide a Vehicle handover, demonstrating how the Vehicle and its equipment/inventory  operate, as well as make you aware of the user/operator guides (including breakdown and accident  reporting guides) contained within the Vehicle.

We will fill out a Vehicle handover/return form, which will document the handover process and will  be included in our Agreement with you.

The provision of fully comprehensive insurance and breakdown cover

  • transport bikes in the vehicle. If requested, we can provide bike racks for an additional  fee.
  • overload the vehicle or load insecurely tow or push other vehicles, trailer or other object • take the vehicle abroad
  • use the vehicle ‘off road,’ which includes driving on beaches, on unsurfaced roads, or on  roads unsuitable for the vehicle (other than within recognised caravan/campervan sites),  you will be responsible for any recovery costs if you become stuck at any time while off  road. This is not covered by the breakdown insurance.

  1. Collection and Return

The vehicle will be available for collection at the agreed time on the day the Hire Period begins.  When you arrive to collect the Vehicle, please allow at least an hour for us to show you around and demonstrate how to operate the Vehicle, equipment/inventory, such as a cooker, sink, fridge, roof,  gas, night heater, and so on, and any optional trip extras you have booked. We must also complete  the handover documentation within that time frame.

Unless otherwise agreed in writing, the Vehicle must be returned by the agreed time on the last day  of the Hire Period. Please return the Vehicle by the agreed-upon time, or you may cause  inconvenience for the subsequent booking of the Vehicle, and we will charge a late return fee (see  clause 10). Please allow enough time to return to our premises so that you do not have to rush to meet the agreed-upon return time.

Collection and return will happen at our registered address, Wakefield Kamper Konversions Ltd  formerly Kamper Kings, 17 Milton St, Wakefield WF2 8TL, United Kingdom, unless otherwise agreed

in writing. You are still fully responsible for the vehicle until we have picked it up, even if we have  agreed that you can return it to a location other than our property or that we will pick it up.

We will perform a preliminary vehicle inspection for any obvious damage as well as an  equipment/inventory check upon receiving the Vehicle back at our premises or the mutually agreed upon alternate location. Throughout the cleaning procedure, a thorough inspection will be performed.  Please give yourself at least an hour to unload your belongings from the vehicle, have them inspected,  and have it all approved.

If no problems are discovered during the vehicle inspection, the security deposit will be returned  within 7 days. We have no control over how long it takes for this to appear back in your account once  it has been processed. If you haven’t received your returned deposit within 28 days of your return  date, please contact us and we’ll do our best to help.

  1. Pick-ups / Drop offs

Bus or train station pick-up (Wakefield Westgate Station) and drop off can be arranged providing the  pick-up location is within 3 miles of our registered address Wakefield Kamper Konversions Ltd formerly  Kamper Kings, 17 Milton St, Wakefield WF2 8TL, United Kingdom. Such pick-ups and drop offs must  be arranged prior to the Hire Period.

  1. Late Return

If you return a Vehicle to our premises after the agreed-upon time without our prior written consent,  you must pay a Late Return Charge (see clause 10) as compensation. You could also be making the  subsequent Vehicle booking more difficult and jeopardising our ability to fulfil the subsequent Vehicle  booking. If the late return of the Vehicle causes us to incur costs in excess of the total payable by you  at this hourly rate, the excess is a debt owed to us by you. Late fees and costs will be deducted from,  but not limited to, your Security Deposit. By entering into this Agreement, you agree to such  deductions. There is no refund for returning the vehicle early.

In the event of an unauthorised late return, the Hirer and any subsequent drivers are personally liable  for any accident or damage to the Vehicle or a third party, or personal injuries to a third party, that  occurs after the end of the originally booked (agreed) Hire Period.

We advise customers to purchase adequate holiday / travel insurance to cover any unforeseen  circumstances.

  1. Occupying the Vehicle

The names and ages of all occupants of the Vehicle during your Hire Period must be listed on the  Booking Form or subsequently in writing to us. Failure to comply with this clause will result in the  insurance becoming void. Additional (unnamed) guests who travelled independently can spend the  night in the awning if you rent one, but they cannot stay in the vehicle overnight.

  1. Health and Safety

When operating the Vehicle and its appliances, as well as when using any ancillary  equipment/inventory in the Vehicle, you must follow the health and safety guidelines. During the  Vehicle handover, the instructions for using the Vehicle, its equipment/inventory, and optional extras,  as well as the health and safety guidelines, will be provided. Guides will also be available within the  vehicle and online.

  1. Seat Belts, Booster and Baby Seats

You can only transport as many passengers as there are seat belts in the vehicle. You are legally  required to obtain and use a child or baby seat. A child must use a child car seat until they are 12 years  old or 135cm tall, whichever comes first, according to UK law. We accept no responsibility for  improperly fitted child or baby seats/restraints or seat belts that are not worn.

  1. Security

You are in charge of making sure that all reasonable measures are taken to prevent dam to, theft of,  or loss from the Vehicle while it is in your care. Make sure the doors are locked, the windows are all  closed, and you have the keys before you leave the vehicle. Don’t hand over the vehicle’s keys to  anyone else or let unauthorised individuals operate it. Avoid parking the vehicle in vulnerable areas  like intersections, street corners, dimly lit areas, and don’t leave valuables on display. By taking these  simple safety measures, you can lessen the possibility of receiving unwanted attention and the  associated distress this can cause.

  1. Keys

At the start of the rental, the hirer is given one set of keys. All costs to replace lost, damaged, or locked  keys in the van will be borne by the hirer, as will any additional costs incurred if the vehicle is stolen.

Duplication of the Vehicle keys is expressly prohibited.

  1. Cleaning

The Hirer is responsible for returning the Vehicle in the condition agreed in the Vehicle handover form,  including internal cleanliness and odour. For the avoidance of doubt, this includes returning the  Vehicle with an empty and thoroughly clean toilet cassette and cassette housing for hires where the  portable toilet was requested as a trip extra. If the Vehicle requires more than our standard clean  upon return to bring it back to its pre-rental condition, allowing for fair wear and tear, or if extra time  is required to ‘air’ the Vehicle before handing it over to another hirer due to unwanted strong smells  such as strong cooking, an additional charge (see clause 10) may be applicable.

  1. Fuel

The fuel tank will be full at the time of pickup and must be returned to us full. Fuel is not included in  the charges and must be purchased by the Hirer. If the Vehicle is returned with less than a full tank,  the cost of any missing fuel, plus a Fuel Administration Charge (see clause 10) will be deducted from  your Security Deposit. If the incorrect type of fuel is used, the Hirer is responsible for all costs  associated with restoring the Vehicle to full operational use. The breakdown cover does not cover the  use of incorrect fuel.

  1. Camping Equipment

Gas is supplied for the burner hob, and we will provide one bottle, which you must return to us. The  Vehicle is equipped with various items such as a cooker, sink, fridge, gas, heater, water storage, and  so on, and we will provide instructions for using the Vehicle, its equipment/inventory, and trip extras,

as well as health and safety guidelines, during the Vehicle handover. Guides will also be available  within the vehicle and online.

  1. Pets

Pets are welcome, but there will be a fee per pet per booking, which will be disclosed during the  booking process in the optional extras section. We reserve the right to charge an additional fee if pet  hair or odour requires extensive cleaning (see clause 10). Please try to keep pets away from all soft  furnishings and cover all soft furnishings. This reduces the amount of hair that becomes embedded in  the material as well as the risk of unwanted fluid coming into contact with the material. Any damage  caused by the pet during the Hire Period will be charged to you.

Please make sure that all pets are restrained during transit and never leave pets unattended in the  vehicle.

  1. Maintenance

If your actions cause damage or breakdown, you will be responsible for the cost of  repair/replacement. This could be due to factors such as overworking the engine or using the incorrect  fuel. This is not an exhaustive list. Check the oil, water, and other gauges and refill as needed. The  mileage on your vehicle on the day of collection will be shown on the Vehicle handover form. If you  cause engine damage by driving too fast (over 70 mph) for too long and ignoring the warning lights,  you will be liable for any repairs or even the cost of a replacement engine.

It is the Hirer’s responsibility to monitor the fuel, oil, water, and coolant levels. 26. Smoking

It is strictly prohibited to smoke or vape inside the vehicle or awnings; please respect this rule. You  will be held liable for any damage (including odour) caused by smoking or vaping to either the vehicle  or contents.

  1. Onsite parking for personal vehicles

During the rental period, parking for your vehicle is available at Wakefield Campervan Hire’s premesis.  If you would like us to store your vehicle, please let us know during the booking process. Your car will  be parked outside our business address, Wakefield Kamper Konversions Ltd formerly Kamper Kings,  17 Milton St, Wakefield WF2 8TL, United Kingdom. We cannot accept responsibility for the loss of, or  damage to, your vehicle or its contents while it is being stored with us unless the loss or damage results  from our negligence. The hirer is in charge of making sure that their car is properly insured.

  1. Events Beyond Our Control

Wakefield Campervan Hire will make every effort to deliver the campervan as requested; however, in  the event that this is not possible due to events beyond our control, such as damage sustained in an  accident, ongoing maintenance, late pickup by prior renters, theft, etc., we will make every effort to  find an alternative, offer alternate dates for rental, or issue a full refund.

Wakefield Campervan Hire do not accept responsibility or pay any compensation for any additional  losses beyond the hire cost, this includes but is not limited to campsite fees etc.

We advise customers to purchase sufficient holiday / travel insurance to protect against any  unforeseen events.

  1. Loss or Damage

You will be liable for all losses and costs incurred by us in the event of the Vehicle, or any parts or  accessories, being lost, damaged, or stolen while in your possession, whether this damage, loss, or  theft involves deception on your or a third party’s part, or as a result of the keys remaining in the  Vehicle while it is unoccupied, or was caused intentionally by you or your party.

Your liability may include the cost of repairs, loss of value of the Vehicle, loss of rental income, towing  and storage charges, and an administration charge, which covers our costs for handling any claim  arising from damage caused to the Vehicle, unless responsibility for the damage lies with us or has  been determined to lie with a third party or their insurers. If the loss or damage is directly caused by  our negligence or breach of this hire agreement, you will not be liable to us for any charge or excess.

  1. Breakdown

Please call us right away at 07730 889848 in the event of a mechanical breakdown, recovery, or repair  service, and then get in touch with the AA Roadside Recovery at 0800 072 5673, policy number  BCASP616509. The Vehicle Handover Information will include all pertinent information. (If you are  having trouble determining which breakdown service to call, please get in touch with us. Otherwise,  if the incorrect provider is contacted, you will be responsible for any costs incurred by us.

If Roadside Recovery is unable to fix the car, you will need to make arrangements to have it recovered.  All repair expenses must be pre-authorized by Wakefield Campervan Hire. We will be liable for repair  costs incurred as a result of breakdown unless the breakdown was caused by your violation of these  terms and conditions. However, we are unable to be held responsible for any additional expenses you  might incur because of an accident, mechanical failure, or any other cause, such as the price of a  replacement car, the cost of rearranging or cancelling travel plans or lodging, phone calls, etc. We  firmly advise customers to purchase sufficient holiday / travel insurance to cover any unforeseen  circumstances.

If you want to continue your journey, you must do so at your own expense and only after the AA  Roadside Recovery Service has arrived and you have handed over the keys to the Vehicle. You may  also return to our location, preferably with the AA Roadside Recovery Service returning your original vehicle. If you arrange alternative transportation to our location, you do so at your own expense. If a  replacement vehicle is available, we will make reasonable efforts to provide it.

In the event of a breakdown caused by mis-fuelling, the hirer is responsible for all costs incurred,  including draining, and flushing the fuel system, any engine parts, including seals, that need to be  replaced, as well as the relevant labour charge, as well as a full tank of fuel.

Please keep in mind that if the vehicle is driven after a fault has developed and causes additional  damage or loss, that damage or loss will not be covered by the AA Fleetwide Breakdown Cover.

  1. Accidents, Theft, and Vandalism

If the Vehicle is involved in an accident, no matter how minor, the full details must be filled out on an  Accident Report Form that is included in the Vehicle. You must report any traffic accident involving the Vehicle to the police (and to us) as soon as possible, and report any loss, damage, or theft involving  the Vehicle to the police (and to us) within 24 hours of the incident or discovery of the incident. You  must return to our location, ideally with the AA Roadside Recovery Service returning your original  vehicle. If you arrange alternative transportation to our location, you do so at your own expense. If a  replacement vehicle is available, we will make reasonable efforts to provide it.

You must ensure that you follow the accident reporting procedure, details of which are in the Vehicle  and were shown to you during the Vehicle handover. An accident or theft report form must always be  completed and submitted to us when you return the Vehicle. For the avoidance of doubt, you must  not admit to any liability, release any party from liability, settle any claim or accept any disclaimer in  the event of the accident, but must take the names and addresses of everyone involved, including  witnesses. We also request that you gather photographic evidence in the event of an accident. In case  of theft, you must return the keys to us.

Unless a third party determines that the accident or loss was caused by our negligence in maintaining  the Vehicle, we will not refund the hire charge for any days you are unable to use the Vehicle due to  an accident, theft, or vandalism. We cannot accept liability for any subsequent costs incurred as a  result of such events, such as replacement vehicle costs, disrupted or re-booked travel or  accommodation, phone calls, and so on. We strongly advise customers to obtain adequate holiday /  travel insurance in case of unforeseen circumstances.

You agree to cooperate with us and our insurers in any investigation or subsequent legal proceedings  arising from the Vehicle’s loss or damage.

  1. Your Liability

You are personally liable for all road tolls, fines, clamping charges, and legal penalties incurred during  the Hire Period (e.g., parking tickets, speeding fines). Any charges reported to us after we have  released, or in excess of, the Security Deposit will be immediately invoiced to you, and payment is due  within 14 days.

You are responsible for any losses or damages caused by you and/or your party, and we cannot accept  liability for any losses or damages, or liability caused by you to yourself or third parties, or to your or  their property. You are fully liable for any damage caused by failing to assess the Vehicle’s height and  colliding with overhead or overhanging objects. The vehicle will come with a sticker indicating its  height.
